Opinion: Mike Davis Says the Judge Who Signed the Omar Raid Warrant Is No Ally of Trump, So the Case Must Be Serious
The Article III Project founder argues a magistrate with Democratic ties would not approve a politically motivated search, and predicts indictments before Christmas.
This is a summary of an opinion column. The views below belong to its author, Mike Davis, founder and president of the Article III Project, not to RightNewsRightNow.
Davis opens with the raid on Rep. Ilhan Omar's Washington home last Monday. Omar's allies call it political revenge. He calls that accusation "laughable."
His argument turns on the judge. Davis says U.S. Magistrate Judge Matthew Sharbaugh, the duty judge that day, "reportedly" signed the warrant, which would mean he found probable cause of at least one federal crime. Davis then lists reasons he thinks Sharbaugh is an unlikely ally of the administration. He says Sharbaugh donated to Hillary Clinton in 2016, twice clerked for Obama appointee Judge Robert Wilkins, and was appointed magistrate in October 2024 by district judges who are "overwhelmingly Obama and Biden appointees." His conclusion: "this matter is serious and based in evidence," and "This is no political hit job."
What Davis says the crime could be. The affidavit is sealed, and he says so. He offers possibilities. One is a question over her naturalization: Omar says she became a citizen at 17 through her father, but Davis notes her staff changed her birth date on her congressional biography in 2019, according to the Library of Congress as quoted from the Washington Post. Under the earlier date she would have been 18. A second is her 2009 marriage to a man Davis says is allegedly her brother. A third is her financial disclosures, which he says jumped from modest assets to about $30 million before she amended them. He also mentions possible RICO charges tied to Minnesota food-assistance fraud. He says the House should investigate and, if she is not a citizen, expel her. His prediction: "Omar would be wise to look out for an indictment before Christmas."
Where this stands. Davis is arguing from a sealed record, and his claims about her family and finances are allegations that the column does not prove. The Fox caption on the story says Omar denies having been told of any criminal investigation, and a Fox report says her attorneys argue there is no legitimate basis for the citizenship inquiry. No charges have been filed, according to the source we read.
