# Federal Prosecutors Say 405 Suspected Noncitizens Cast More Than 1,500 Ballots in Washington State, and Call It the 'Tip of the Iceberg'

The acting U.S. attorney says he sent the names to state election officials and asked them to set aside the ballots until eligibility is checked. He offers no statewide count to back his claim of 'thousands.' Washington has not handed over its full voter database.

Federal prosecutors in Washington state say they have identified 405 people they believe are not U.S. citizens who voted in state elections, Breitbart reports.

What was announced. Neil Floyd, the acting U.S. attorney for the Western District of Washington, said Monday that those 405 people cast more than 1,500 ballots over multiple elections. His office sent the names to state election officials and asked them to set aside any ballots from those voters until their eligibility can be checked.

His claim. Floyd said the findings were made "with high confidence" and that the number is "only the tip of the iceberg." From the small sample so far, he said, "I'm confident that we are looking at thousands of non-citizens who have been voting in Washington."

How they found them. Department of Homeland Security investigators compared publicly available Washington voter lists with federal records to flag registered voters they believe were not citizens, then checked whether those people had voted. Floyd said each match needed several checks to confirm it was the same person, which made the work slow.

The dispute over data. Floyd said Washington has refused to share its complete voter list with identifying information, so the work is being done "essentially one person at a time." With the full database, he said, a comparison would "yield immediate results." He added that his office will pursue criminal cases against people who vote illegally and those who knowingly help them.

Context. Breitbart notes that Los Angeles County officials told a court last week they cannot independently verify voters' citizenship beyond what voters state on their forms, and that the Justice Department has sued California over more than 20,000 registered voters it calls likely noncitizens. We covered that suit earlier.

Note for readers: the 1,500 ballots are the prosecutors' allegations, not court findings, and Floyd gave no statewide figure to support the "thousands" estimate. Breitbart cites a report saying the ballots were cast over several decades. We did not see the list of names, and the people on it have not been shown to have been charged. Midterm elections are Nov. 3.
