Erika Kirk Asks Utah Court to Reject a 2029 Trial Date for Charlie Kirk's Accused Killer

A filing from Kirk's legal team calls the defense timeline 'grossly out of line' and asks for the earliest practicable date in 2027. The defense says a firm date now would be 'false precision' in a death penalty case.

Erika Kirk is fighting the schedule the defense wants for the trial of the man accused of killing her husband. Fox News reports on a court filing it obtained in which her lawyers ask the judge to reject a proposal that would put the trial in 2029.

The ask. Kirk's team calls the defense timeline "grossly out of line" with comparable cases and wants a trial at the earliest practicable date in 2027. They cite Utah law giving crime victims the right to a speedy disposition without unwarranted delay. They also want monthly progress reports or status conferences, and want the family's interests weighed before any scheduling extension is granted.

The family's argument. The filing says every added day of delay "carries the weight of all that Charlie's murder has taken from his family." Charlie Kirk's two children were three and one when he was killed, and under the defense schedule they would be seven and five by the time of a verdict. The filing also cites a report that Tyler Robinson's defense cost taxpayers about $1.6 million in its first year.

The defense. Robinson's lawyers propose a tentative start in the third quarter of 2029. They argue a firm date now would create "false precision" and could jeopardize his rights in a capital case, where, as they put it, "death is different." They point to pretrial motions planned through 2029, a large volume of evidence still to be reviewed, and the difficulty of selecting a jury.

The prosecution. Per Fox, prosecutors expect to be ready by Oct. 4, 2027. Utah County Attorney Jeffrey Gray said an October start would run through Thanksgiving and Christmas, so the state proposes a start on Jan. 31, 2028. Prosecutors estimate about 17 weeks of trial. The defense expects six to seven months.

The case. Robinson, 23, was ordered in September to stand trial on seven charges, including aggravated murder, over the Sept. 10, 2025 shooting of Charlie Kirk at a Turning Point USA event at Utah Valley University. He could face the death penalty if convicted.

Note for readers: Robinson is accused, not convicted. The judge has not ruled on a date. Details are as reported by Fox News.
