A top Homeland Security lawyer is warning noncitizens not to vote on Tuesday, Fox News reports.

What he said. DHS general counsel James Percival spoke Saturday on "My View with Lara Trump." "Whether it's now or later, if you illegally cast a vote, we will find you, we will charge you, and we will deport you," he said. He also said more than 200 people have been charged in connection with noncitizen voter fraud.

The arrests. Percival's remarks followed a Wednesday DHS press release saying ICE has arrested dozens of noncitizens on charges tied to illegal voting. Secretary Markwayne Mullin said in the release, "American elections are for Americans only." DHS says some of those arrested have criminal histories that include assault with a dangerous weapon, domestic violence, drug trafficking, burglary and drunk driving.

The pushback. Some state officials dispute the federal findings. Washington Secretary of State Steve Hobbs challenged a Justice Department claim that investigators found more than 400 noncitizens illegally registered in the state, some of whom allegedly voted in multiple elections going back decades. Hobbs said the list "includes United States citizens and is not reliable," and that it would be "irresponsible and illegal" to refuse a registered voter's ballot without individual proof. He added that many people on the list are not currently registered or are inactive.

What to keep in mind. The arrest and charge counts come from DHS and its officials, and we have not seen the charging documents or the names. The Washington dispute is unresolved, and the Fox piece does not say how many of the 200 charged have been convicted.
