Bibas Family Relative Asks the ICC to Pursue Iranian Leaders, Saying the Court Has Ignored the Victims of Oct. 7

Maurice Shnaider, uncle of Shiri Bibas, is backing a legal filing seeking warrants for two Iranian officials. The ICC says its Palestine investigation is ongoing and it does not disclose details.

A relative of the Bibas family is asking the International Criminal Court to hold Iran's leaders to account, and says the court has not responded.

Maurice Shnaider is the uncle of Shiri Bibas, who was taken hostage on Oct. 7, 2023, with her sons Ariel, 4, and Kfir, 9 months. All three were later murdered in captivity. Shnaider's sister and brother-in-law were killed at Kibbutz Nir Oz the same day. He told Fox News Digital that the grief "doesn't compute in my body" and that "the most I can do is fight them in the way I can."

The filings. Elliot Malin, president of Stratos Council, filed a case on Shnaider's behalf in September 2025. It asks the ICC to investigate and seek warrants for two Iranian officials for crimes against humanity, war crimes and genocide in Israel and Gaza on and after Oct. 7. One of the two was killed during the current conflict with the U.S., Fox reports. In December 2025 Malin filed a second case seeking warrants for more than a dozen Hamas members. Malin told Fox the Islamic Republic is the "principal" behind its proxies and should be held directly accountable. He argues the court has jurisdiction because the crimes happened in Gaza, even though Iran is not a party to the court's founding statute. He says the ICC has not answered either case, and wants a filing for each family that lost relatives.

The ICC's reply. The Office of the Prosecutor told Fox it is "actively investigating all crimes committed within the Court's jurisdiction since 13 June 2014" in the Situation in the State of Palestine, and does not disclose details to protect the process and the people involved.

The backdrop. Fox notes that former chief prosecutor Karim Khan, who was removed for misconduct, oversaw the 2024 warrants for Israeli Prime Minister Benjamin Netanyahu, former Defense Minister Yoav Gallant and Hamas commander Mohammad Deif. Malin calls that "selective justice." Earlier this month Secretary of State Marco Rubio announced sweeping financial sanctions on the court, saying Americans "are not subject to the jurisdiction of this fake ICC."

Reader note. Shnaider and Malin are advocates in this case. Whether the court will open an investigation is not known.
